 Terms & Conditions

These terms of use (the “Terms”) govern access to and use of the services described below (the “Services”) made available by Maxpro Group Ltd, trading as Dacwash (“Dacwash,” the “Company,” “we,” “us,” or “our”), through its mobile applications and the www.dacwash.com website (together, the “Application”), by any person who accesses or uses the Services (the “User,” “you,” or “your”).

Use of the Services is conditional on the User's acceptance of these Terms. If the User does not accept these Terms, the User may not access or use the Services. These Terms are published on the Application so that the User may review and retain them.

The Company reserves the right to modify these Terms at any time. Changes take effect when the updated Terms are published on the Application. Continued use of the Services after publication constitutes the User's acceptance of the changes.

1. Services

The Services principally consist of the on-location washing of cars and motorcycles, including at public roads, and in particular:

•          cleaning of vehicle exteriors, glass, rims, and application of black tire dressing;

•          cleaning of vehicle interiors.

The Company provides the Services using its own staff and, in some cases, third-party suppliers engaged under contract with the Company (“Third-Party Suppliers”). The Company reserves the right to modify how the Services are delivered, and to suspend the Services, or any part of them, at any time and for any reason.

In more detail, the Services include:

•          cleaning all external surfaces of the vehicle with dedicated products, including the bodywork, exposed window surfaces, and rims. If the vehicle exceeds 1.70 m in height, the User must provide a ladder for the washer's use;

•          cleaning the vehicle interior with dedicated products, including plastics, interior glass, fabrics, door sills, floor mats, and vacuuming of footwells and the trunk. Items found inside the vehicle will be moved as needed to complete the cleaning and returned to their original position. For interior cleaning, the User (or a person designated by the User) must personally open and close the vehicle; the User is not required to hand over the vehicle keys to the washer;

•          sanitization of the passenger compartment and air filters using an aerosol product. For this service, the User (or a person designated by the User) must start the vehicle engine and set the air conditioning system to maximum power in recirculation mode. If the User cannot perform these steps, the User may ask the washer to do so, and the washer will return the keys once the service is complete.

The washer may need to take photographs of the vehicle to support quality control and proper performance of the Services. These photographs are visible only to the User within the Application and are not shared with third parties.

The Services may be offered alongside third-party services or content, including advertising, that the Company does not control. Use of such third-party services and content may be subject to separate terms and privacy policies. The Company is not responsible for the products, services, or content of Third-Party Suppliers or for any change to third-party products, services, or websites.

2. Use of the Services

Account Registration

To use most features of the Services, the User must register and maintain an active personal account (the “Account”). The User must be at least 18 years old, or the age of legal majority in the User's jurisdiction if higher, to register. Registration requires certain personal information, such as name, email address, mobile phone number, and a valid payment method.

The User agrees to keep Account information accurate, complete, and up to date, including a valid payment method. Failure to do so may result in loss of access to the Services. The User is responsible for all activity on the User's Account and must keep the Account username and password secure and confidential at all times. Unless the Company agrees otherwise in writing, each User may hold only one Account.

User Requirements

The Services are not available to persons under 18. The User may not let third parties use the User's Account and may not allow a person under 18 to receive the Services unless the User is present. The User may not assign or transfer the Account to any other person or entity. The User agrees to comply with all applicable laws when using the Services and to use the Services only for lawful purposes.

Push Notifications

By creating an Account, the User agrees that the Company may send push notifications as part of the normal operation of the Services.

Promotional Packages

The Company may, at its sole discretion, create promotional packages redeemable for Account credit or other benefits related to the Services and/or Third-Party Supplier services, subject to additional conditions the Company sets for each package (“Promotional Packages”). The User acknowledges that Promotional Packages:

•          must be used only by their intended recipients and for their intended purpose, and only in a lawful manner;

•          may not be duplicated, sold, transferred, or made available to the public unless the Company expressly authorizes it;

•          may be disabled by the Company at any time, for any reason, without liability to the Company;

•          may be used only in accordance with the specific terms the Company sets for that package;

•          have no cash value; and

•          may expire before use.

The Company may withhold or deduct credits or other benefits obtained through a Promotional Package if the Company determines, in its reasonable judgment, that the Package was used or redeemed in error, fraudulently, unlawfully, or in violation of its applicable terms or these Terms.

Network Access and Devices

The User is responsible for obtaining the data network access needed to use the Services. Any messaging or data charges incurred in accessing the Application or using the Services are the User's sole responsibility. The User is responsible for obtaining and maintaining compatible hardware or devices needed to access and use the Application and Services. The Company is not responsible for any unavailability, suspension, or interruption of the Application or Services caused by internet or electronic communications malfunctions or delays.

Cancellation Due to Weather

The Company may cancel a wash, up to the last practical moment, if weather conditions (such as rain, storms, or snow) prevent the service from being performed or make cleaning unnecessary. If this occurs, the Company will notify the User that the Service cannot be performed.

Cancellation Due to User's Failure to Cooperate

The User agrees to provide the Company with complete and accurate information needed to identify the vehicle and perform the Services correctly. If incomplete or incorrect information prevents the Company from performing the Service, the Company may charge the User the full value of the booked Service.

3. Intellectual Property

License Granted by the Company

Subject to the User's compliance with these Terms, the Company grants the User a limited, non-exclusive, non-transferable, non-sublicensable license to: (a) view, download, and print Company content solely for the User's personal, non-commercial use; and (b) view any User content the User is permitted to access, solely for personal, non-commercial use.

The User will not use, copy, adapt, modify, create derivative works from, distribute, license, sell, transfer, publicly display, publicly perform, transmit, stream, broadcast, or otherwise exploit the Services, Application, or any content made available through them, except as expressly permitted in these Terms. No rights are granted by implication, and all rights not expressly granted are reserved by the Company and its licensors.

License Granted by the User

The Company may, at its discretion, permit Users to post or submit content (“User Content”). By submitting User Content through the Application, the User grants the Company a worldwide, non-exclusive, transferable, royalty-free license, with the right to sublicense, to use, reproduce, adapt, modify, distribute, and display such User Content solely in connection with operating and promoting the Services. The Company does not claim ownership of User Content.

4. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES AND APPLICATION ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. THE COMPANY DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, THE COMPANY DOES NOT WARRANT THAT: (A) THE SERVICES OR APPLICATION WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (B) THE SERVICES WILL MEET THE USER'S REQUIREMENTS OR EXPECTATIONS; (C) ANY DATA STORED WILL BE ACCURATE OR RELIABLE; (D) ANY ERRORS OR DEFECTS WILL BE CORRECTED; OR (E) THE APPLICATION OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. THE COMPANY MAKES NO WARRANTY REGARDING ANY SERVICES OR GOODS OBTAINED THROUGH A THIRD-PARTY SUPPLIER.

NOTHING IN THIS SECTION EXCLUDES OR LIMITS ANY WARRANTY OR RIGHT THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

5. Internet and Communications Delays

The Application and Services may be affected by limitations, delays, and other problems inherent in the use of the internet and electronic communications, which are outside the Company's control. The Company is not responsible for delays, failed deliveries, or other harm resulting from these problems, except to the extent caused by the Company's own negligence or breach of these Terms.

6. Limitation of Liability

THIS SECTION LIMITS THE COMPANY'S LIABILITY TO THE USER. NOTHING IN THIS SECTION EXCLUDES OR LIMITS LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED, INCLUDING LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, FRAUD OR FRAUDULENT MISREPRESENTATION, OR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT, WHERE SUCH EXCLUSION IS PROHIBITED BY APPLICABLE LAW.

Subject to the paragraph above, and to the maximum extent permitted by applicable law:

•          Neither the Company nor its officers, employees, agents, or licensors will be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of data, revenue, profits, use, or other economic advantage, arising out of or relating to the Services or Application, even if advised of the possibility of such damages.

•          The Company's total aggregate liability to the User for any and all claims arising out of or relating to the Services or these Terms, however arising (including in contract, tort, or otherwise), will not exceed the greater of (i) the amount the User paid to the Company for the specific Service giving rise to the claim in the twelve (12) months before the claim arose, or (ii) 100 AED.

•          The Company is not liable for any loss, damage, or injury arising from or connected with the Services or Application, including the use or inability to use them, reliance on advertising content, or any transaction between the User and a third-party service provider, advertiser, or sponsor referenced through the Services.

•          Where the User (or a person designated by the User) hands the vehicle keys to the washer to allow the washer to perform tasks the User would otherwise perform (such as opening the vehicle or starting the engine) for a specific Service (e.g., interior washing or sanitization), the Company and its staff are not liable for any damage arising from or connected with the washer performing those tasks, except where caused by the washer's gross negligence or willful misconduct.

•          Each provision of this section applies separately and survives even if a remedy fails of its essential purpose.

The User agrees to indemnify and hold harmless the Company, its officers, employees, and agents from any third-party claim, loss, or expense (including reasonable legal fees) arising from the User's breach of these Terms, misuse of the Services, or violation of applicable law, except to the extent caused by the Company's own negligence or breach of these Terms.

7. General Provisions

The User may not assign or transfer these Terms, in whole or in part, without the Company's prior written consent. The User consents to the Company assigning or transferring these Terms, in whole or in part, to: (a) a subsidiary or affiliated company; (b) a buyer of Dacwash's capital, business, or assets; or (c) a successor following a merger.

If any part of these Terms is held invalid or unenforceable, that part will be interpreted, consistent with applicable law, to reflect the parties' original intent as closely as possible, and the remaining provisions will remain in full force and effect.

These Terms constitute the entire agreement between the Company and the User regarding their subject matter and supersede all prior or contemporaneous agreements or understandings on that subject.

The Company may notify the User through a general notice on the Services or by email to the address on the User's Account. The User may notify the Company in writing at:

These Terms are governed by the laws of the United Arab Emirates, without regard to conflict-of-law principles, and any dispute will be subject to the exclusive jurisdiction of the competent courts of Dubai, save where applicable law grants the User the right to bring proceedings in the User's home jurisdiction.

The User confirms having carefully read, understood, and specifically accepted the following clauses: Network Access and Devices; Cancellation Due to Weather; Cancellation Due to User's Failure to Cooperate; Disclaimer of Warranties; and Limitation of Liability.
